Please read these terms carefully. By using Home Executive Suite you agree to them.

1. About this service

Home Executive Suite ("the Service") is a household staff administration platform that helps households in South Africa manage onboarding, leave, payroll, documents and disciplinary records. The Service is provided as software only; it does not employ any person and is not a party to any employment relationship between a household and its staff.

2. Accounts and roles

Households ("employers") register accounts and may invite staff members ("employees") to onboard. Each party is responsible for the accuracy of the information they provide and for keeping their login credentials secure. You may not share your login or allow unauthorised access to your account.

3. Acceptable use

You agree to use the Service lawfully and only for genuine household employment administration. You may not use the Service to harass, defraud, or unlawfully process the personal information of any person, nor to upload malicious or unlawful content.

4. Employment responsibility

The Service provides templates and tools (including contracts, payslips and leave calculations) to help users meet their obligations under South African law, including the Basic Conditions of Employment Act, Sectoral Determination 7, the National Minimum Wage Act and related legislation. These tools are provided for convenience and do not constitute legal, tax or financial advice. Users remain solely responsible for compliance with all applicable laws, for the correctness of wages, deductions and UIF, and for fair treatment of staff. For complex matters you should consult a qualified professional.

5. Electronic signatures

Documents may be signed electronically within the Service. In terms of the Electronic Communications and Transactions Act, 2002, an electronic signature is legally valid and binding. By signing electronically you confirm that you intend to be bound by the document signed.

6. Personal information

The Service processes personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and our Privacy Policy. Employers act as the responsible party for their staff's information; the Service acts as an operator processing information on their behalf.

7. Fees

Access to the Service may be provided on a subscription basis. Fees, billing cycles and any free-trial terms are set out at sign-up and may change on reasonable notice. Failure to pay may result in suspension of the account.

8. Availability and data

We take reasonable steps to keep the Service available and to protect your data, but we do not guarantee uninterrupted access. You are encouraged to keep your own copies of important documents. We are not liable for loss arising from service interruptions or data loss beyond our reasonable control.

9. Limitation of liability

To the extent permitted by law, the Service is provided "as is". We are not liable for any indirect or consequential loss, or for any loss arising from your reliance on templates or calculations without independent verification. Nothing in these terms limits liability that cannot lawfully be limited.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these terms. On termination, statutory record-retention obligations may still apply to employment records.

11. Changes

We may update these terms from time to time. Material changes will be communicated to account holders. Continued use after changes take effect constitutes acceptance.
